eBay seller to avoid

Anyone who may be thinking of purchasing from eBay seller san-market (store: Big Celebrity Fashion ) would do well to think twice.
They currently have a listing for custom Han Solo pants that show only one picture of the pants - made and photographed by kay-dee, who has contacted eBay to report this as this picture is being used without her permission. They also just sold a custom order for a Han Solo vest, which also used kay-dee's photo of the vest she made without her permission (or prior knowledge - fortunately someone was browsing eBay and came across the listings, recognized kay-dee's photos from her website, and let her know about this).
They have lots of other cosplay costume listings and I'm inclined to suspect that many of the images are not of actual items they have made themselves, so the buyers would not be getting what is pictured, nor perhaps even close to it.
Buyers beware!

Thanks for the info. The same thing happened to me when another seller used a photo of my Luke ROTJ costume to sell their "custom" version. My photo's not used now - but they're using a photo of the Sideshow figure!

I can verify that for some of their Gothic Lolita Outfits, the picture was taken from the Goth Loli Sewing Magazine-Book.

I've gotten ahold of Son of the Suns and Crazy Old Wizards to ask around if those are anyone's Anakin or Obi-Wan photos. The smiley face covering the costumer is all too suspicious.

Yeah, I noticed those smiley faces. That would suck if they can get around the 'using my likeness' violation by simply covering up the person's face. And they were pretty dumb to think that just because my photos are not of a person they could use them and watermark them! Photo copyright states that if *I* took the picture (and I did) I'm the owner and I have authority to say if a picture can be published or used. I also sent a signed fax off to photobucket to make them take down my pictures from their account.
Ebay has just been going downhill over the years with bad sellers. No ethics at all. Buyers have to be so careful now.
It's too bad we can't get them to remove all the auctions with the lolita magazine pictures. If there is a way to contact that magazine and if they care, they could easily force ebay to remove their photos from the listings too!

Sadly, the magazine is a Japanese one and is it just me or the Japanese Companies are not as "concerned" about these kind of violating of copyright as the US/UK Companies or ODEX Pte Ltd; if it had been the case, many of the people who're selling Cosplay Costumes like Clothings off the rack or Non-Singapore Anime Downloader would had been sent C&D Letters and charged a long time ago.

(current ones are called Gothic Lolita Sewing if I remember correctly. Mine had been put away for now)

Regrettably, we will only be able to take action if the owner of the images or text writes to us. In some instances, sellers may have
obtained permission to use the material. Therefore, we often cannot remove listings based on the representations of third parties whose credentials we cannot verify.
We do understand the potential for further issues in this type of situation. That is why, if you feel strongly about this issue, we recommend that you contact the owner of the images or text, and recommend that they contact us directly. Once we hear from them, we will take appropriate action.

It really terrible how they handle it now.
I remember back then, when we had some problems with some people using Fan's Costumes Photos from ACS-LOTR Website Scrapbook, eBay responded promptly and had the item removed. Now, everything is going in circles and delayed like hell.
Ya, guess they valued these sellers more than us as they're the ones who giving them the profits.

Yeah, that's the exact same response I got too. I replied back to them and said they would find that the owner of the images HAD contacted them about this issue.
I hope kay_dee is getting somewhere with eBay on this.

I got further with them: I got a form that needed to be faxed in by the owner of the images. I sent that on to Kathy, but it doesn't look like Ebay's done anything about it yet.

Playing Devils Advocate here but it could be that E-Bay could have been burned by a third party request to have a listing removed where image use was authorized by their respective owners and found themselves in an actionable position. Liability always has to be a consideration by any corporation and if there is no complaint by a person who has copyright there is no reasonable complaint. If you know the original owners of an image that is not in the public arena, contact them and let them know that it is being misrepresented and back that persons statement up.
