April 22ndWhile we appreciate your enthusiasm for the MAX PAYNE property, as you are likely aware, Fox acquired the exclusive motion picture rights from Take Two Interactive for the MAX PAYNE property. Fox further acquired an exclusive trademark license for the mark MAX PAYNE for a wide range of goods and services, including motion pictures. Your activities and materials, including your film, trailers, and one-sheet posters violate Fox's rights as well as the rights of Take Two Interactive in the underlying video game. Fergle Gibson
May 5thWe spoke to the Vice President of Intellectual Property at Fox this evening... and they have agreed to letting us continue production. However, we're no longer allowed to distribute the film publically, which means everyone of you who has stood by and supported us over the years will never *officially* get to see the film. Further reason to hate Fox.
They'd probably do this to Star Wars, if they could.
That's kinda weird, I was just playing the "The Fall of Max Payne" for the last couple of days.
EDIT: He's got a quote on the top of his page from the creator of Max Payne saying he's looking forward to it. How cool would it be if we see some strings pulled in the future?
I can dream. This film looked cool.

FOX has canceled/discontinued a few good shows and/or movies. One of the good if not great shows was Firefly. FOX has a tendency to not be able to see a good thing even if it's in front of their faces, so they brush it off and put up the next crappiest reality TV show. If it weren't for the Simpsons, American Dad, and most especially Family Guy, I wouldn't bother with FOX TV. Also let's not forget they canceled Family Guy at one point. It was brought back due to DVD sales.

...that's all I can say right now. I really really wanted this film to make it. Like, more than most other films I've seen in the works, for a long time. I guess a massive viewer revolt is out of the question too, huh. Bummer.

Hmmmm.
Am I sensing a protest of the official film on the horizon? That'd be tough to organize, especially with Average Joe movie goer... but this is an interesting idea.

I doubt that any kind of grassroots campaign would work, not enough people would know what the cause is. Fox has no artistic ties to the Max Payne property, it’s just an investment. If for some reason They though it would loose serious money they’d do the opposite and put the screws further on the Payne & Redemption crew, which would be counter-productive for everyone… but they’re stuck up their asses enough to do it. Out of spite. Right now they just sent a C&D letter, which hell I can snag a tempate for and mail them in protest.
From a fan point of view I still say the best thing would be to repackage the thing and release it under another production umbrella away from Fox’s reach. Preferably a different country, like under the Pirate Bay’s umbrella or the crew that released Star Wrek on DVD.
I don’t know if that would be useful form a career point of view though. Butting heads with Fox may close some doors but on the other hand infamy when spun properly could be a good one-shot career boost.

Just a suggestion, but maybe you could ditch the name max payne and create your own characters inspired by the game. That way you'd own the IP and could also sell the dvd without running into copyright issues. Just call it "Pain" or something and have the main character called max (assuming thats what everyones calls him in the film so far)
I can understand the whole legal thing, but people should have the right to make whatever the heck they want to, as long as they state its unofficial and dont make any money from their work. I guess the only good that can come out of this is you are forced to make an original project, which might turn out better than the fan one

When you consider that the character and whole story had already been done in different incarnations dozens of times before, why not? The only thing that made the game seem unique at the time the was the photo-textures (which look kinda silly now) and the bullet-time aspect (which came from John Woo and was probably inspired in this case by the Matrix). The source material is nothing original and changing a few names, bits of the story, and costumes a little would hardly change anything.

What kills me is that this was going to be the first attempt done right at Max Payne - no other film has come close to the video games and no "hollywood" film exists (yet.) So really Fox just wants to control anything related to the franchise because they could...not because it's going to cost them at all.
I wonder if the other MP fan films have taken a hit at all...

Cease and Desist orders are part of fan film life. And especially if "Hollywood" is about it come out with the film version. MANY Superman and Batman (Warner Bros.) fan films were issued them when those newer version movies came out. Several Stargate (MGM) fanfilms got them a few years ago. And I know of at least one Star Trek (paramount) fanfilm. (And I heard about an Alien fan film too.)
It's not just FOX....
Penitio's guarantee way to avoid C&D orders, don't advertise online, until it is finish. Once done, and viral, they can't issue you a C&D's order... you go up the scale to law suit.
