Since the title of the thread is "Where's the line?", I hope I can be allowed to ask a few questions of our own that have come up in the past during discussions like this. Suppose a moderator had received word of something through an AIM channel where s/he heard that a user was going onto the JCC to follow someone around for the intention of annoying and baiting them. Now while their posts are within ToS, because of an offsite disclosure, we know there is malicious intent behind it. It's not information we were seeking, it's something we just picked up offsite. With someone's intention realized, do we still play it by the book, risk the situation becoming worse and wait for a person to break ToS before jumping in? Or protect the user being stalked early enough before it escalates because we know the true intent?
As much as I appreciate the jury analogy, I really don't think it correlates. If a user is stupid enough to post at an open offshoot board or in the chat or wherever that they plan to do something malicious, I think it's fair game to moderate that.
For example, with harpuah's example earlier. If you were in the chat and Harpuah said "I'm going to show that lexu what's what" or you saw her post on an offshoot board "I hate lexu, I'm going to write something really vile to her" then it's fair game to edit and warn or ban Harps for flaming. Likewise, if you see an offshoot board where Harpuah and lexu are posting and Harps says "lol look what i just posted" and lexu responds "lol oh noes my labia!!" then it's fair game not to edit (or to edit without warning, if it just sounds offensive even as a joke).
