    My local Episcopal Church several years ago actually declared that they weren't going to perform any legal marriage ceremonies until marriage equality happened in CA.

    Sounds like some wish to politicize the Court because - you know, the Court is clearly political because some of their judgments don't align with some. So the solution is to pack it with "yes men."

    ("Packing" the Court is just as wrong whomever does it - the nominee should be intelligent, reasonable, and open minded, IMHO.)

    Lol. Gosh, don't give me nightmares about conservative Zombies.

    Sorry to throw a wrench in this, but there are like five other orientations besides homosexuality and straightness. Just sayin'. I hope we can have threads discussing the defense of my sisters and brothers.

    I mean, that's how it should work at least. If you sincerely have an objection to it, don't work in the county clerk's office. At least that's better than working there and just openly breaking the law and insulting people by refusing licenses.

    I agree. I wish the pharmacists who think it's any of their business whether women use birth control, would do the same.

    Obviously the REASON conservatives are now all of the sudden calling for justices to be subject to periodic, yes or no reelection (like many lower court judges in many states and counties) is hilarious and contemptible, but I've always thought the supreme court system is a bit of an absurd holdover institution in the context of a modern democracy, with all its attendant communications and medical technology. But I know admittedly little about legal institutions in general, so I was hoping someone more knowledgeable might like to comment on some of the good or bad ideas for reforming the supreme court of the United states

    Specifically, I'm interested in how similar high courts work or have worked in the past in other countries... my impression has been that other countries don't do the "life in office" thing, just based on the fact that a number of non-American from have expressed surprise to me when the fact that supreme court justices are appointed for life had come up in conversation...

    The idea, of course, is that life-time appointed judges that were subject to legislative approval were to be immune from popular opinion - i.e. to do the right thing, not the popular thing.

    Of course, when those two things don't align, you get calls to change the system.

    I think there's a medium between life in office and being subject to elections. The purpose of not being elected is that justices aren't supposed to answer to the will of the people, as much as voters sometimes think they are. Justices can still obviously be political, but they are also able to make unpopular decisions. The court was designed specifically for this purpose, so the idea that they should be accountable to the electorate would destroy the system of checks and balances.

    The court often makes decisions that are socially ahead of its time. And if the people really strongly hate a decision, they can appeal to their representatives to pass a constitutional amendment and reverse a decision. That's their check.

    The question of whether justices should serve for life, though, is a different one. I think limiting it to a certain age is a bad idea. Then you'd just get a rash of very young justices elected for political reasons. But if they had an actual term, say 20-25 years or so, that could be more logical. Although I'm still not sold on it and would love to hear the counterarguments to that.

    In the UK judges are said to a very isolated group of people to avoid said bias, reading the Times newspaper and generally steering clear of notice.

    Unless you're Lord Denning then you specialised in making equitable rules on the fly and were constantly in the legal spotlight...

    Term limits are an idea... anyone know other countries that do that in the high courts?
