I think first offenders should be forced to do community service in the kind of job where they must clean up the mess they created. IE, repairing computers in schools and libraries that have been ruined or rendered useless by viruses and spyware. Any resulting costs (ie new equipment, software etc) would come at their personal expense. Their personal computer(s) should be confiscated, wiped of all virus and spyware making software and donated to a school. As well, they will be prohibited FOR life from owning any computer equipment (even a PDA) or having a personal internet connection. Their conviction will go on their personal record that will come up anytime a company wants to do a background check on them, and any company that hires them for a position where they might have to work on a computer will be required to have their IT staff routinely audit that person's computer use to ensure that they are using it for legitimate business practices only and report their findings to the person's parole officer.

Failure to comply of course results in stiff fines and jail time.

Of course this would never happen because it would require the convict to take personal responsiblity for their actions.

Pay a set fine for each spam that was sent out. I would set it at $100 per each individual email.

If they can't pay then off to jail they go.

I also believe that those in jail should be working and paying their way.

They have to pay for room rental, food, clothing etc. No free TV, books, exercise equipment, University degrees, no voting etc.

If you don't want to work you don't eat.

It irks me that it costs us something like $50,000 a year to keep someone behind bars and the victims of crimes get nothing.

    Rant over

Sabrina, many judges do a technology restriction similar to that you suggest already. For instance anyon caught counterfeiting isn't supposed to own or use any printing equipment, including photo copiers without legally appointed supervision.
