Senate The Supreme Court

    Mostly because it strikes me as deeply illusory. It ignores enormous cultural changes that arise in even very homogenous cultures that stress continuity and stability. Realistically, whatever is being praised as "classic" or "traditional" probably only existed transiently. If change happens regardless of the demographic pattern, then is it really sensible to use the latter as a stand-in for the former? Likewise, is there anything that precludes things from retaining value even as they are introduced to new peoples? In light of all this, the mealy-mouth talked of "demographics" seems little more than coded language for disliking other ethnicities because they are not one's own.

    Now that one of the courts of appeal has ruled on gay marriage, and Utah is appealing the decision to the Supreme Court, how long until SCOTUS takes it up?

    Yeah, that's some good news.

    Who knows? Depends on which case (there are dozens of them now), the Court decides to take up and when.

    I know I've predicted at least 6-3 in favor, willing to go to 7-2. We can start a betting pool if you like?

    It would have to be, considering the split in Federal Circuit appellate divisions.

    Some are saying that the ruling will be all states have to recognize marriages performed in other states, but don't have to perform them.

    More concered at the moment with how it's going to decide Obamacare (again).

    There's a Federal standing issue if someone can get married in one state, get a financial tax break, and can't get married in another. Discrimination.

    Does anyone know of any other big cases the Supreme Court will decide in June? I remember hearing that ObamaCare is on trial, again, but haven't heard much about that in months (though I'm also in a job this year with little access to wifi and cell service).

    whos the remainder in the three? (we all know who the two are lol) alito, right? cuz roberts being a legacy hound will go the way the wind is blowing if it looks 5-4

    With three left, it'd be Scalia, Alito, and Thomas. With two left, I can see a very small window in which Scalia joins the majority and writes his own narrowing view, but that's sort of a pipe dream.

    how often do thomas and scalia decouple these days though? i know it happens but not very often, right?

    One thing Scalia hates more than Federal overreach or Liberalism in regards to state's rights, are states then pretending they are not subject to courts and US law and intentionally trying to force what ... Alabama (?)... tried to do. He's also, I believe, generally been on the side of most clarifying rulings that fix massive discrepancy between state to state issues, though I believe it's been some time since something's come up.

    EDIT: And there's virtually 0 chance I see Thomas breaking. None.

    I cannot see Scalia changing his position on gay marriage. Ever.

    Does the Supreme Court seem likely to deliver a blow to ObamaCare?

    I really haven't been able to keep up with the details on that case.

    Opinions are mixed.

    Could go either way.

    Politically, it's a disaster for the GOP, no matter how it rules.

    Not for the ones who will be harmed, no.

    My point is: be careful what you wish for.

    The republicans wanted the law gone, but they will absolutely own whatever happens in the aftermath.

    Especially if the decision is 5-4.

    And they have no plan in place if the law is nuked (not that the GOP ever intended to have a plan; they probably want the poor dead in the first place)
