    not really SCOTUS, but may end up there...

    Kansas Supreme Court has decided that the state's public school system isn't constitutionally valid. This sounds bad on its face, but is actually quite good.

    It's unconstitutional because the state was shorting poor school districts intentionally apparently and the courts have held that's a no-no.

    I wish he didn't have to die in order to leave the Supreme Court, but I'm glad his self-serving idiocy is gone.

    Looking forward to the nomination fight!

    It's going to be brutal for all involved. I'm not sure I would want to be nominated if I were on the radar screen for that.

    The Republicans in congress, with the chance of a Republican in the white house in less than a year, are going to fight tooth and nail. This may be the hardest fought nomination of Obama's term.

    Darth Guy points out pending cases for this years SCOTUS can still proceed.

    It will be interesting to see if any nominee is even put forward.

    Lord Vivec, may be the hardest fought? You're talking about a chance to shift the balance leftward. It will be the hardest fought.

    From what I know of Earl Warren's tenure, a new justice can immediately start participating in cases. IIRC, the Court heard Brown v. Board before Warren was appointed, yet he was responsible for the unanimous ruling.

    That's absolutely the case. On the other hand, the longest Supreme Court nomination battle in American history was Clarence Thomas at 107 days. There's no way the Republicans can plausibly hold things off all the way until Obama leaves office. This will be a miserable process, but it will be his.

    Obama's first choice is likely to be blocked, no matter what.

    If I were him, I'd nominate someone super-progressive first, so when the second/real choice comes... someone center-left... that person will be much more likely to be confirmed, though they would have been rejected as a first choice.

    This election cycle has been unprecedented in numerous ways. Things aren't as usual. I fully expect the GOP to fight this to the political death if necessary. SCOTUS was one of their salient issues going into this election. Expect the unexpected.

    Yeah, I posted this on my FB:

    "I'm trying to find out when the session ends, but I think they only have to hold out 7 or 8 months and not the full 11... but it might cost them the election. The only real problem is that Obama may have to nominate someone more 'centrist' to get it through, versus a new Dem president likely able to say '**** you, Jobu, I do it myself' and going full liberal."
