You know who are probably smarter (or at least more qualified to decide the legality of such things)? The Supreme Court justices with law degrees and years (likely decades) of legal experience.


But, hey, that's just what I think.

I assume by "came first" you mean it historically happened earlier. This is of course irrelevant to what usus marriages actually were. As I understand, confarreatio was mostly practiced by the patricians. Meanwhile, the usus marriages were without ceremony or religious connotation and were, for much of Roman history, the most common type marriage among the majority of the inhabitants of Rome.

I'd find it odd if an arrangement similar to usus didn't predate the establishment of Rome altogether, but I admit I'm no authority on Etruscan history.

Yeah, but obviously our beloved action star of a governor was carrying out the will of the people all by himself.

Well, the ideas behind it are particularly Roman. Just as the state religion involved contracts with the gods, then so did marriage involve a contract--even unwritten--between two partners. I can't imagine that usus as an idea existed before Roman society developed, but there were likely some sort of cohabitory arrangements.

You couldn't call those marriage by any sense of the term, though.

Because! happy Marriage means something to those who hold it to who it was intended for... God. Marriage is defined as recognizing the commitment between a man and a woman before God. To redefine it is to say that it is to be redifined indefinitely, to suit the current social climate. So, IMO, don't change what is a marriage. Take the same advantages and do civil unions, or whatever you want to call it. Just don't call it marriage.

Okay I'm being silly, but essentially we're talking about redefining marriage. So why do people have issues with polygamists/Mormans then? They do the same thing right? They practice marriage differently than most people do too.

Or, how about we keep marriage as it is defined and allow exceptions to the the tax code/wills, rights, etc - and leave marriage and it's definition alone?

Marriage isn't just about God though, millions of people get married in civil ceremonies that have no mention of religion whatsoever. They are still called marriages. The religion argument and anything about God is completely irrelevant.

I find it fascinating that anti-gay marriage folks love to trot empty and cliched arguments like this out, as if they're worth anything.
