Anidanami, we live in system that has checks and balances to make sure no one part of the system gets too much power. That even means the power of the people. It needs to be checked and that is what the Supreme Court in CA did today. The people voted to pass a law that violates the Constitution. They do not have that power. They were overturned by the SC which has the power to check them.
EDIT: Also it's funny that you talk about low voter turnout when we're seeing RECORD turnouts for voting in the US primaries. Shoots your little theory all to hell.

My dad is moving out tonight. Apparently his marriage to my mother was destroyed by the lack of a ban on same-sex marriage in California.
EDIT: Okay, so ^that's^ not very clever or funny. Anybody else want to try for the "Gay marriage destroys 'real' marriage" joke?

Which is, kinda, it's job, isn't it? To balance out the other two branches - legislature and executive - when they have gone somewhat astray? Sure they're not supposed to legislate, but in an ideal world the legislature would've dealt with this. In my ideal world, my legislature and executive wouldn't be incredibly closely linked and 90% supreme over my judiciary. But that's the UK for you.
Indeed ... balance is the key word, not do their job for them. The legislatures should have figured out that they were screwing up royally decades ago.

I really find appeals to classical (read: "anachronistic") definitions of terms funny; fundamentally it commits the fallacy of "appeal to tradition". Further, if marriage is religiously based, then my mother and step-father aren't really "married" since they married themselves a la the Quaker tradition. And no, they aren't Quakers. Language changes; I'm not sold on "civil union" as separate from "marriage" precisely because marriage now incorporates both religious and secular unions, both of which provide a class of rights unavailable to individuals in monogamous relationships. It makes more sense to me for people of any sex to do what they currently do now: pick whether they want a religious or secular service, and find the official capable of performing it. Then it won't matter whether one was "married" by a priest, rabbi, Universal Life Church certificate bearer, etc., themselves, or the JOP.

Zebula... no matter how many times you say the legislature "should" have fixed this themselves, it doesn't change the fact that they didn't and the Supreme Court performed its function properly and within the bounds of the Constitution.

It can not be a coincidence.
I'm not gay, so this doesn't really affect me but if people wish to receive tax and social related benefits of having a recognized union between two people of the same sex, then just call it a civil union and be done with it. The title of marriage should be recognized as it always has been traditionally - between a man and woman.
