Babysitter gives child Benadryl; mom sues the drug company

    ok, woman sues baby sitter for given her kid a fatal dose (3 teaspoons) of Benadryl. Losing a child hurts, but I doubt her suing a company that did not serve her child the medicine, and they did not taint the medicine, should be sued. I mean, this medicine is meant to help millions, and in no way did the companies involve make something to do harm.

    Anyway, the cash isn't doing any good for her child.

    I wish the company did give the fatal dose, but not to the child but instead to the mother, so I woudn't have to waste time reading a thread the demonstrates perfectly, the infinate reaches of human stupidity

    And she's suing the pharmacy. That makes even less sense.

    The saddest part, until the lawsuit was that the babysitter was 53 and didn't tell the paramedics about the benadryl.

    On the other hand, what kind of idiot would sue the pharmacy that sold the medication?!?!

    Is she only suing for $15,000? The company will settle just to avoid the bad press.

    I remember reading once about people wanting to sue Smith and Wesston (sp)? because their guns kill people. But we know that people kill people. It's all for the money in this case and it makes me sick. Obviously the babysitter doesn't have $1,000 in savings. I mean, why sue the drug company and pharmacy, it was human error on the babysitter's side. Not like she e-mailed Pfizer Inc "Can I give 3 teaspoons to a kid" and they said, "yeah", or the pharmasist says, "sure." Well so far, I imagined they didn't but this just makes me mad. I'm no doubt going to pay more for a prescription if she wins. Heck, I'm still proably paying more, since the lawyers have to be paid, etc., no matter the outcome.

    I can see suing the the Polk County Health Department and the state Department of Children & Families, though I think it's stupid also.

    I have not seen anything to indicate grounds for suing the drug company or the pharmacy. From the looks at it, the person to blame is the babysitter, and maybe the mother for leaving her child in an unlicensed day care center.

    Unless the medicine does not have the standard "Infants and children under 2 years: consult a physician before administering" disclaimer, the manufacturer cannot be held at fault. The sitter probably exceeded the indicated dose for an adult; how can anyone blame the pharmacy or drug company for that? (What, did the Eckerd's pharmacist say, "Yes, you can give that to children"?)

    Kind of like how if someone gets drunk and stubs their toe, they just go downt he line suing the bartender for not stopping him, the trucker who brought the beer there, the guy who screws the caps on the Budweiser, and finally the company who thought of the idea of making money off people getting smashed.

    Well, if people sue to make the world a better place for children, then maybe if the babysitter had to be registered, meaning she had to take several classes a year, so at some point she was better informed about how much medicine she should give, or at least have have the tacher hit her over the head for asking "should I give Benadryl to quite a kid," then I could see the use of suing the county. But still, it's all for the money then for the kid, I think, with this mom.

    side note: um, these snow flakes are, um pretty. distractin, but pretty.

    Dissapointing that the babysitter wouldn't of thought to look at the bloomin' label of the Benadryl: it would of clearly stipulated dosage restrictions as well as age-restrictions which could of avoided this tragedy.

    I read the article and from that it seems the only person culpable is the babysitter. I mean, c'mon! You're watching a 3 1/2 month old and you give them that much Benedryl??? That's more than the dose for a 50 lb kid! (which depending on the kid would be about 5 years old).

    It would be nice if the mother was able to stay home and take care of her kid herself but that isn't always possible these days so mothers are forced to put their kids into day cares. The mother should have put her kid in a licensed day care. THEN she might have had a case against the state or county for giving them a license.

    All this will lead to is a settlement, and the company that makes benadryl will be required to put a warning on their label stating that the product is not safe for children.

    Why do you think blow dryers have tags on them that say "Do not use while sleeping"? Because someone once got the bright idea of blowing their hair while sleeping to save time, laying the blow dryer on the pillow. Of course, a fire started, and the dunce who did it sued the blow dryer maker for not warning her.

    I'm glad that old hag burned herself and i wish someone would burn her house down while she was in it
