[Fail] Topeka, KS considering decriminalizing domestic abuse

    No, with the arbitrator and the arresting officer as witness, they have two choices, go straight to jail with a minimum sentence of a three days and a big fine fine and counseling and probation or face the actions of the courts and get six months for their crimes. Two choices, gives the chance to be cheap or expensive. if its expensive its expensive for the criminal in time. if its cheap its cheap for the criminal and the system and the criminal may not be allowed to screw up or else.

    The defendant will not be able to make any deal if they choose not guilty. its all or nothing.

    In Albany county in NY the DA decided that anyone who doesn't take a breathalyzer for DWI and has to go to the hospital for the blood test gets no deal whatsoever. This happened after a few rich people refused to the breathalyzer and got the lawyers to make a deal and did it again. So the DA gave you two options, take the test or face maximum punishment.

    You mean, accept a plea bargain, or plead not guilty and go to trial?


    Er... that's pretty much what happens now.

    But make the plea bargain in the jails at the time of arrest.

    There is no constitutional right to have to wait six weeks for a trial when it can be only five minutes to decide whether or not you want to plead guilty or not.

    Well, there's that whole "you have the right to speak to an attorney" thing that you are overlooking.

    And who says that they still can't have a trial. You can still give the person the option. Call it a limited time offer. Go to your attorney, plead not guilty and get six months in jail and a big fine. Accept what you did, take the limited time in jail and fine and get counseling.

    There is nothing against limited time offers.
    especially for domestic violence and DUI.

    you are caught with the evidence and the choice is simple. Spare the city of the money and spare your life or be ignorant and get served.

    That is what we do in traffic court. You all file in and the town attorney gives you an option, take the plea bargain like a parking on the pavement and a fine or go to court and lose.

    There is no difference in offering it up to something for all misdemeanors.

    The 2nd artile argues that they will still be punished, just not by the city, however the 1st article says said those in jail for domestic violence will be let out. So when they are let out with the county or state now jail them?

    "Tragic" is a better word. Remember, this is the tea party we're dealing with, where if one does not drop to their knees in worship of Sarah Palin they are in fact "liberal", regardless of their true political preference.

    Throw in the fact that I am no longer completely against gay marriage and see no point in arguing about abortion, and voila, I am in fact "too liberal" for the Republicans.

    I think sensible republicans still exist. It's just that they've got no power...no real voice. I think they're squashed by the social aspect of the party and have to keep silent or be labeled as "RINO's" or some **** like that.

    Wouldn't it be nice if there was some sort of moderate faction that could come out and overshadow the Tea-baggers?

    Ugh...I hate being the kind of guy that has no problem with the death penalty and actual fiscal responsibility...not the kind that repubs these days try to preach. For some strange reason I believe that teachers are not as evil as oil executives.
