Actually regardless of whether she lied, it will still probably be classified as kiddie-porn and become illegal. It may not even be allowed to be auctioned on ebay in that case.

At 17 she isn't legally allowed to consent, so whether or not she lied may not matter in a legal sense. It will come down to a matter of whether the game company acted in good faith and at least tried to verify that she was 18 or older.

Technically it is not material and the jury will be instructed not to consider that an issue. The point is that at 17 years old she can't legally willingly choose to appear nude. 18 years old is the fine line, so whether it is a 5 year old or a 17 year old, the company making porn is fully fault. I do doubt the girl will get any damages payment, but the game will become illegal, even to those who already own it.

Traci Lords pulled the same thing off right after turning 18. She was doing porn for several years starting at age 15 or so. Around the time she actually turned 18 she started her own company and made a few movies while over 18. Then she releases the information that she was 15-17 in most of her movies and the films were then dubbed illegal. Thus most of her films were no longer available, so when the publicity came out and people were interested in getting her movies, she made a bundle by selling the only available legal movies with her in them.

 

Ya'know, crap like that should be illegal. In the "legal" sense or not, people like Traci Lords KNOWINGLY pulled a legality stunt in order to profit off of someone else's illegal actions. That should be punished.
